Nature of work by Town Planning Department :-
Implementation of the development plan, acquisition of land under reservation, scrutinizing the matter of building permission and doing other ancillary works as per development control rules, providing technical support and guidance with necessary information regarding unauthorized construction, and taking action in the departmental case proceeding in the case under the Maharashtra Regional and Town Planning Act 1966.The term "Bridging the Gap" refers to the process of bridging the gap between the present and the future. The excluded area's development plan was approved on August 25 and went into effect on October 15, 2000.Objections / Request for Suggestions on Draft Revised Development Plan - 2022-37 Draft Revised Development Plan no. Mibhavi/Prasuvio Mira-Bhaindar/Section-26 Publicity/2587 dated 27/10/2022, published in Maharashtra Government Gazette on 28/10/2022.
City Development Plan :-
Mira Bhaindar town has a land area of 79.40 square kilometres and 19 revenue villages.The Mira Bhaindar town development plan was approved on May 14, 1997, and went into effect on July 15, 1997, excluding the excluded area.In addition, on August 25, 2000, the development plan for the excluded area was approved, and it has been in effect since October 15, 2000.Also, in the approved Development Control Regulations, Government Decision No. Modifications have been approved vide TPS-1208/1346/Pro.No.267/08/Navi-12, dated August 29, 2009. Thereafter, the implementation of Integrated Development Control and Promotion Regulations under the Maharashtra Regional Planning and Town Planning Act 1966 has been approved as of December 2, 2020.
MMRDA has been appointed by the government as the special planning authority for Mahsuli village in Mira Bhayandar Municipal Corporation area, and through MMRDA for the said area, independent development plan letter no. IPB-4312/323/CR-23/2013/UD-11 dated May 13, 2013 and letter no. TPB 4316/P.No.257/2016/Navi-11 dated March 16, 2017 are being prepared. Development Control Rules have also been implemented for the aforementioned village letter nos. IPB-4312/323, CR-23/2013, and UD-11 dt. as of May 13, 2013.
No. from the Urban Development Department. As per notification TPB-4316/Pro.No.257/2016/Navi-11, dated March 16, 2017, the appointment of MMRDA as Special Planning Authority for the above-mentioned notified area has been canceled, and the said area has been excluded from the notified area and included in the respective municipal limits. And the development plan approved by the government on May 13 and June 3, 2016 is to be implemented by the respective municipalities within their jurisdiction.
Rental Housing Scheme :-
The provision of a housing scheme on a rent basis for Mira Bhaindar city has been implemented by the government, and thus, location clearance has been received from. MMRDA in 13 cases and construction approval has been given in those cases.. 4562 flats have been transferred from the said project, and another 5177 are going to be transferred to MMRDA..
Mhada :-
Housing scheme provision as per the 2.50 mat area index is applicable for MHADA-owned areas. According to this, the proposal of MHADA has been approved, and the work on the said proposal is going on. 2279 flats have been provided to MHADAs from this project.
Civil Amenities Area :-
Eight of the 26 plots of facility area received from various development proposals in the Municipal Corporation area have had work completed, with six more in the works. Construction is to be proposed on the remaining 12 sites.
Affordable Housing Scheme :-
According to the government's decision, under the Affordable Housing Scheme, location clearance along with drawing approval has been given for 4 places, and out of these, 2 proposals have been given construction permission. The number of flats to be transferred to the Affordable Housing Unit from the said proposals is 417.
Amendment Proposal:-
In the development plan of Mira Bhaindar Municipal Corporation area, the amendment process for the proposal under section 37(1) of the Maharashtra Provincial and Town Planning Act, 1966 is carried out.
C. R. Z :-
CRZ prepared by CESS for the Mira Bhaindar Municipal Corporation area The classification maps were received by the Municipal Corporation on June 30, 2005.
According to the Central Government's Coastal Regulation Zone Act 2011, the Coastal Zone Management Plan (CESS) has been prepared by the organization after re-surveying the municipal area, and the updated maps have been published on their website through the authority of the government, MCZMA.
Proposal for Building Permission :-
01/06/12 new cases of building permission are being processed online through Auto-DCR system. The said action is being done due to JNNURM Reforms and a total of 287 building permission / revised building permission proposals have been approved through Azmitis online system. At present, the building permission is being granted as per the Unified Development Control and Promotion Regulations (UDCPR) dated 02/12/2020.
Development Size Recovery :-
Following is the comparative year wise development size from the year 2016-17 accumulated as sanctioned development proposals in approved development plan for Mira Bhaindar Municipal Corporation area.

Development Rights Certificate ( TDR ) –
The areas under reservation in the sanctioned development plan of Mira Bhaindar city have been acquired through development rights certificates.
The total area under acquisition is 1187727.04 sq. m. The area under the development plan is 274201.15 sq. m., and the area under reservation is 913525.89 sq. m.
As previously stated, the average quick counter rate for vacant land in Mira Bhaindar Municipal Corporation is Rs 25,000 per square meter. As a result, the land under reservation or in a development plan, as described above, is valued at around 3000 crores. The aforementioned lands were given to Mira Bhaindar Municipal Corporation for free.
Revised Development Plan –
As the approved development plan for Mira Bhaindar city expires in 2017, the General Assembly has expressed its intention. As a result, the government has directed the creation of a map depicting existing land use (ELU). Proceeding through the Director, Urban Planning Thane Branch.
Theater -
Village Mahajanwadi S.No. (old) 92 out of (new) 13/1 The total area of Amenity Open Space in this place is 5255 sq. A 3-story theatre is proposed in the area, and the construction area of the said theatre is 3674.93 sq. And the art gallery (Amenity Open Space) on the fourth floor has a floor area of 785.19 square meters. Thus, the total construction area of 4460.12 sq. m. BhumiPujan was performed on August 30, 2015, at the aforementioned location by Mr. Shri Uddhavji Thackeray and Mr. Vinodji Tawde (Minister of Social Affairs and Culture).
By developing this reservation, It has been inaugurated by Uddhavji Thackeray
Proposed Administrative Building –
Village Bhaindar, S.No. 487/pt.,pt., 478/pt.,pt.,pt. (Old), 114/1,2, 113/1,2,4 (New) in this place, the administrative building of the Municipal Corporation of about 1.5 lakh sq.ft will be handed over free of cost from the developer and the Bhumipujan of the said building will be handed over to Hon. Chief Minister Mr. Hon. DevendrajiFadnavis and Mr. GirishjiMahajan, Water Resources Minister presided over on 24/10/2015. Since there is a dispute over the ownership of the place in the said place, Mr. As per the instructions of Collector Thane, Mira Bhaindar Municipal Corporation has suspended the construction permission in the place at present.
Ghodbunder Fort –
To start the beautification work of Ghodbunder Fort in Mira Bhaindar Municipal Corporation area, Mr. After following up with the Collector, Thane, 1000 sq.m. The land has been transferred and the remaining land is being pursued for transfer. As soon as the said place is handed over, the beautification work of the fort will be done.
Scanning -
In order to update the records in the records room of the Urban Planning Department and to preserve the records by scanning them and to make the information of the housing project easily available to the public, the process has been started to publish the said records on the website of the Municipal Corporation. Also, the process has been started with the view of giving construction permit along with plowing certificate, occupation certificate, area map and zone certificate online.
Right to Information –
According to the Central Right to Information Act 2005, Town Planning Department has been appointed as First Appellate Officer and Assistant Town Planner as Public Information Officer and this department receives an average of 200 RTI applications and about 30 first appeal applications per month.
Regarding the said appeal and RTI application, action is taken within the prescribed period.
Urban Surveying –
The government has given approval on 30/01/2007 to carry out urban land surveying of Mira Bhaindar Municipal Corporation area by a private organization and according to the prescribed procedure three (M. Rane Management Consultant Pvt. Ltd., Bhaindar, M. Monarch Surveyor and Consultant Pvt.) completed the tender process. Ltd., Pune and M.P.N.Shidore and Company, Kalyan have been appointed and mandated on 25/01/2007.
The said organizations have completed the survey work of 14 revenue villages and submitted the report in the office of Taluka Inspector Land Records, Thane, but the survey work has not been done due to the opposition of the local people in five revenue villages, namely Village Uttan, Dongri, Pali, Tarodi, and Chowk in the municipal area.
For the surveyed area, further action is under way through the Hon'ble Jamabandi Commissioner and Director, Land Records (Maharashtra State), Pune.
Regarding land conversion tax certificate –
Development plan zone wise of the land within the municipal corporation limits regarding getting the tax certificate. A certificate is issued through Tehsildar, Thane. Only then is construction permission granted by the municipal corporation.

Regarding mobile towers in Mira Bhaindar Municipal Corporation Area
- Number of Mobile Towers permitted under the then existing policy but lapsed due to non-extension - 109
- Since the said 109 mobile towers have not been extended as per the existing policy, the information along with the list has been communicated to the Encroachment and Unauthorized Construction Control Department and the Ward Office from time to time to take action against the said unauthorized mobile towers.
- The Department of Telecommunications (DOT) of the Central Government had given an Advisory Guideline to the State Government on 01/08/2013.
- The State Government has finalized all inclusive regulations / policies vide Government Decision No.TPS-1810/1975/P.No.Navi.65/12/Vio/Navi-13, dated 04/03/2014.
- The policy has been finalized by partially modifying the policy vide 03/10/2013.
- The planning authority has the power to grant permission for mobile towers.
- It is mandatory for existing mobile tower owners and proposed mobile tower owners to obtain permission.
- Administrative Fee Rs.30,000 / -
- As per the prevailing rules, the development amount has to be paid.
- It is mandatory for mobile tower owners to get permission within 180 days for erecting without permission.
- According to the above policy, the mobile companies have not taken permission, but against the government's policy dated 04/03/2014, Hon. In the High Court, Bombay Writ Petition No. 2043/2014 and 2047/2014 have been filed. The High Court on 12/09/2014 has issued the following directions as per the guidelines issued by DOT dated 01/08/2013.
- “State Govt. and / or all authorities and / or the concerned Municipal and / or Local Corporation are restrained from taking any coercive steps and also to accept the application as per the quidelines issued by D.O.T. for erection of towers”
- Under the prevailing circumstances, the municipal corporation has issued an office circular no. MBMC/NR/3291/2015-16, dated.19/11/2015 is issued. Paying the fee accordingly. Reliance JioInfocomm Ltd. He has taken permission for a total of 55 mobile towers. An amount of Rs.62,24,800 /- has been paid.
- Meanwhile, according to the decision of the General Administration Department of the State Government dated 17/02/2018, the telecommunication infrastructure policy of the state has been determined. Mainly the amount of administrative fee is Rs.10,000 /- per mobile tower and validity of mobile tower permission is fixed as 5 years.
- In the said policy, instructions have been given to issue necessary guidelines to their subordinate civil local bodies regarding documents and procedures. However, the detailed instructions of the Urban Development Department are yet to be issued to the local bodies. Therefore, as the approval/renewal of mobile towers in the Municipal Corporation and the income received from the Municipal Corporation has been affected, Hon. The policy has been fixed Hon. Commissioner So., OrdervideNo. MBMC/NR/Mobile Tower/5388/2018-19 dated 14/12/2018. Accordingly, action is being taken on the proposal received for the regularization of mobile towers erected without permission in the Mira Bhaindar Municipal Corporation area and at present permission/renewal has been given for a total of 203 mobile towers with an amount of Rs.27,41,523/- (year 2021-22) and an amount of Rs. 11,69,458/- (Year 2022-23 – Month to July 2022) and an amount of Rs.39,10,981/- has been paid.
